These Terms of Service ("Terms") govern your access to and use of the website operated by Magmade Design & Artwork Services (trading as Magmade Studio) and the purchase of any products sold through it (the "Site"). By using the Site or placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order.

Custom & Personalized Products

Items sold on the Site are made to order using photos and personalization text supplied by you. Because each item is produced individually:

  • Minor variations in print colour, alignment, cropping, sheen, or finish are inherent to custom production and do not by themselves indicate a defective product.
  • If you need to change or cancel an order, please contact us as soon as possible. We can consider requests only before production starts; once production has started, the order cannot be changed or cancelled.
  • We do not accept returns or exchanges of personalized items for a change of mind. If an item arrives damaged, defective, or incorrect, or we cannot fulfil your order, the remedies in our Returns & Refunds policy apply. Nothing in this section limits your rights under applicable UAE consumer protection law.

User-Submitted Content — Your Photos & Text

When you upload photos or submit personalization text (“User Content”), you represent and warrant that:

  • You own the User Content or have all necessary rights, licences, consents, and permissions to provide it to us and authorise us to use it to produce your order.
  • The User Content does not infringe any third party’s copyright, trademark, right of publicity, right of privacy, or other rights.
  • The User Content is not obscene, defamatory, hateful, harassing, or otherwise unlawful, and does not contravene the laws or public morals of the United Arab Emirates.

We reserve the right, but have no obligation, to refuse to produce any order whose User Content we reasonably believe violates these Terms or applicable law. If we refuse to produce an order after payment, we will notify you and refund the amount paid for the affected order.

Indemnification

You agree to indemnify and hold harmless Magmade Design & Artwork Services and its owners, employees, contractors, and agents from any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) any third-party claim of intellectual-property, publicity, or privacy infringement based on your User Content; (c) your breach of these Terms; or (d) your violation of any law or right of a third party.

Orders & Acceptance

Your submitted order is an offer to buy. A binding contract is formed when we send the order-confirmation email. After confirmation, we reserve the right to cancel an order if we discover a pricing error, reasonably suspect fraud, determine that the submitted photos or text violate these Terms or applicable law, or are unable to fulfil the order due to production capacity. If we cancel an order, we will notify you promptly and refund any amount paid for the affected order to the original payment method. Nothing in this section limits your rights under applicable UAE consumer protection law.

Pricing & Payment

All prices are shown in AED. Accepted payment methods are shown at checkout. Any applicable taxes, shipping charges or other fees are calculated and disclosed before payment.

Shipping & Delivery

Each order has a production period before it is dispatched. Estimated production times and delivery times are set out in our Shipping Policy. Delivery times after dispatch are estimates and may be affected by the carrier or circumstances outside our reasonable control. If we cannot meet the stated production window, we will notify you and offer the options described in our Shipping Policy. Nothing in this section limits your rights under applicable law.

Intellectual Property — Site Content

All content on the Site other than User Content — including logos, product imagery, text, and software — is owned by or licensed to Magmade Design & Artwork Services and is protected by UAE and international intellectual-property laws. You may not reproduce, modify, distribute, or publicly display any such content without our prior written permission.

Relationship with Shopify

The Site is hosted on the Shopify platform, operated by Shopify Inc., which provides the online e-commerce service that allows us to sell to you. Your use of the Site is also subject to any applicable Shopify terms.

Consumer Rights

Nothing in these Terms excludes or limits any rights you have as a consumer under applicable law.

Disclaimer of Warranties

To the extent permitted by law, the Site and products are provided "as is" and "as available" without warranties of any kind, except those that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, Magmade Design & Artwork Services shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or the products. Our total liability for any claim shall not exceed the amount you paid for the order giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under UAE law.

Prohibited Uses

You agree not to use the Site to: (a) violate any law or regulation; (b) infringe the rights of any party; (c) interfere with the operation of the Site; (d) attempt to access non-public areas or systems; or (e) submit fraudulent orders or false personalization information.

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Governing Law & Jurisdiction

These Terms are governed by the laws applicable in the United Arab Emirates. Any dispute relating to these Terms will be subject to the courts of Dubai, without limiting any rights you have under applicable law.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Site with a new "Last updated" date. Continued use after changes constitutes acceptance.
